Terms of Use

1. Definitions

• "PulseDeck" refers to the PulseDeck desktop application software
• "License" refers to the right to use PulseDeck granted upon purchase
• "User", "You" refers to the person who purchased or uses PulseDeck
• "We", "Us" refers to the developer(s) of PulseDeck

2. License Grant

Upon purchase, we grant you a personal, non-exclusive, non-transferable, lifetime license to use PulseDeck on your computer(s), subject to the following terms:

• The license is for personal use only (non-commercial)
• You may install PulseDeck on multiple computers you own, within the activation limits set on your license key
• The license is tied to your license key and cannot be transferred or resold to another person
• The license is valid for the lifetime of the product — no recurring fees or subscriptions

3. Free Version

PulseDeck offers a free version with limited functionality. The free version:

• Provides access to a subset of modules (monitoring, volume, news)
• Has a reduced launcher grid size
• Limits the number of custom webviews
• Does not include advanced features such as system actions, profiles, custom themes, or gaming mode

The free version is provided as-is for evaluation purposes. You may upgrade to the full version at any time by purchasing a license.

4. License Activation

License activation requires an internet connection. Your license key is validated through Gumroad's API. A machine fingerprint (anonymous hardware identifier) is generated locally to associate the license with your computer.

• Activation increments a usage counter on Gumroad's servers
• An offline grace period of 7 days is provided — PulseDeck will continue to work without internet for up to 7 days after the last successful validation
• If your license key is found to be refunded or chargebacked, access will be revoked

5. Restrictions

You agree not to:

• Redistribute — share, resell, sublicense, or distribute PulseDeck or your license key to others
• Reverse engineer — decompile, disassemble, or attempt to extract the source code of PulseDeck
• Modify — alter, adapt, or create derivative works based on PulseDeck
• Circumvent — bypass, disable, or tamper with the license verification system
• Misrepresent — claim authorship or ownership of PulseDeck

6. Intellectual Property

PulseDeck, including its code, design, icons, documentation, and branding, is the intellectual property of its developer(s). All rights not expressly granted in these terms are reserved.

Your purchase grants a license to use the software — it does not transfer ownership of the software or any intellectual property rights.

7. Third-Party Services

PulseDeck integrates with third-party services that have their own terms and conditions:

• Gumroad — license management (Gumroad Terms)
• Google Calendar API — optional calendar integration (Google Terms)
• Home Assistant — optional smart home integration (your own instance)
• Webview modules — Spotify, YouTube Music, Twitch, etc. are loaded via embedded webviews and subject to their own terms of service

We are not responsible for the availability, content, or policies of these third-party services.

8. Disclaimer of Warranties

PulseDeck is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that:

• The software will be error-free or uninterrupted
• The software will be compatible with all hardware or system configurations
• All features will function identically across different Windows versions
• Third-party integrations will remain available indefinitely

PulseDeck reads hardware sensors and system information for display purposes only. We are not responsible for any inaccuracies in the data reported by your hardware or the underlying system libraries.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of PulseDeck, including but not limited to:

• Loss of data or system configurations
• Hardware issues or system instability
• Inability to use the software due to license or activation issues
• Actions performed through the launcher (system shutdown, restart, etc.)

Our total liability shall not exceed the amount you paid for the PulseDeck license.

10. Refunds

Refund requests are handled through Gumroad in accordance with their refund policy. If a refund is granted:

• Your license key will be automatically invalidated
• You must uninstall PulseDeck from all your devices
• Continued use after a refund constitutes a violation of these terms

11. Updates

We may release updates to PulseDeck from time to time. Updates may include bug fixes, new features, or changes to existing functionality. We are under no obligation to provide updates, and updates may modify or remove features at our discretion.

12. Termination

We reserve the right to terminate your license if you violate these Terms of Use. Upon termination:

• Your license key will be invalidated
• You must uninstall PulseDeck from all your devices
• No refund will be provided for licenses terminated due to violations

13. Changes to These Terms

We may update these Terms of Use from time to time. Any changes will be reflected on this page with an updated "Last updated" date. Continued use of PulseDeck after changes constitutes acceptance of the updated terms.

14. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of France. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the French courts.
